1. Welcome to our web site (“www.monokol.it“, the “Website”). These General Terms and Conditions (the “Terms & Conditions”) govern the access to and use of the Website, and regulate the offer, transmission and acceptance of purchase orders relating to products between the users of the Website and Oculus S.r.l.
2. Please read these Terms & Conditions carefully. By accessing and using the Website as well as by purchasing the products on the Website, you agree to be bound by these Terms & Conditions. If you do not agree to all or part of these Terms & Conditions, we invite you not to use our Website. This Website is managed and maintained by Oculus S.r.l. (“Oculus”, “we”, or “us”) with registered office in Viale delle Industrie 36, 81100 – Caserta (Italy), tax code and VAT number IT03827420617, emails info@oculuseyewear.it – info@monokol.it.
3. Oculus S.r.l. may amend or simply update all or part of these Terms & Conditions. Any amendment or update of the Terms & Conditions shall be posted for our users on the Home Page of the Website as soon as such amendments or updates have been made and shall be binding as soon as you access the Website after they are amended. If you do not agree to all or part of the Terms & Conditions as amended or updated, please do not use our Website.

2. USE OF THE WEBSITE
1. The access to and use of the Website, including display of web pages, communication with provider, downloading product information and making purchases on the Website, are carried out by our users exclusively for personal purposes, which should in no way be connected to any trade, business or professional activity.
2. Remember that you will be liable for your use of the Website and its contents. Oculus shall not be considered liable for any use of the Website and its contents made by its users that is not compliant with the laws and regulations in force, without prejudice to provider’s liability for intentional torts and gross negligence.
3. In particular, you will be liable for communicating information or data which is not correct, false or concerning third parties (in the event such third parties have not given their consent) as well as for any improper use of such data or information.

3. PRIVACY POLICY AND USE OF COOKIES ON THE WEBSITE
1. We recommend that you read our Privacy Policy at the end of terms and conditions ref. Privacy Notice Art. 13 – Regulation 679/2016 – GDPR, which also applies in the event that users access the Website and use the relevant services without making purchases. The Privacy Policy will help you understand how and for what purposes Oculus collects and uses your personal data.
2. We use cookies to improve your experience with our Website. Cookies are small files that websites send to the user’s device, and are used for online browsing. Cookies allow us to gather information on how people use our site.
3. Are they mandatory? No. You can restrict, disable or re-enable cookies at any time via the internet browser of your computer. Please, pay attention when you access these web sites through the links provided on the Website and carefully read their terms and conditions of use and their privacy policies. Our Terms & Conditions and Privacy Policy do not apply to the web sites of third parties. The Website provides links to other web sites exclusively to help its users in searching and surfing the Internet and to allow links to web sites on the Internet. When Oculus provides links to other web sites, Oculus does not recommend that its users access these web sites and it does not provide any guarantees as to their web content or services and products supplied and sold by these web sites to Internet users.

5. INTELLECTUAL PROPERTY RIGHTS
1. All content included on this Website, such as works, images, pictures, dialogues, music, sounds, videos, documents, drawings, figures, logos, menus, web pages, graphics, colours, schemes, tools, fonts, product designs, diagrams, layouts, methods, processes, functions and software (collectively, “Content”), is the property of Oculus and is protected by national and international copyright and other intellectual property laws. You may not reproduce, publish, distribute, display, modify, create derivative work from, or exploit in any way, in whole or in part, the Content without the prior express written consent of Oculus as the case may be.2. Oculus shall have the exclusive right to authorize or prohibit in its sole discretion any reproduction, publication, distribution, display, modification, creation of derivative work from, or exploitation in any way of, in whole or in part, the Content. Oculus shall have the right, at any time, to claim the authorship of any Content posted on this Website and to object to any use, distortion or other modification of such Content.3. Any reproduction, publication, distribution, display, modification, creation of derivative work from, or exploitation in any way of, the Content expressly authorized in writing by Oculus shall be carried out by you for lawful purposes only and in compliance with all applicable laws.

6. DISCLAIMERS ON CONTENT AND LIMITATION OF LIABILITY
1. Oculus has adopted measures to ensure that the Content of the Website is accurate and does not contain any incorrect or out-of-date information. However, Oculus cannot be held liable for the accuracy and completeness of the Content, except for its liability for tort and gross negligence and as otherwise provided for by the law.2. Moreover, Oculus cannot guarantee that the Website will operate continuously, without any interruptions and errors due to the connection to the Internet. We will not be liable for any failure, any suspension or any termination of access to the Website arising out of any event beyond our reasonable control.3. The products displayed on the Website may not exactly correspond to the real items in terms of image, dimensions and colour depending on your Internet browser and/or your monitor quality.4. Except for cases of gross negligence and fraud, in no event will Oculus and/or its affiliates be liable to the buyer for lost profit or any damages of any nature arising out or related to these Terms & Conditions and/or in connection with third party claims raised against the purchaser of products from this Website.5. The total amount of Oculus’s liability in respect of the purchase of products under these Terms & Conditions is limited to the amount paid by the buyer for the purchase of the products.6. Liability based on statutory provisions protecting consumers shall remain unaffected.

7. ORDERS
1. To place an order you shall select the products you desire to purchase on the Website, select a size, and add the items to your cart by clicking on “Add to Cart”. Once you are ready to checkout, click on “Cart” at the top right of the screen, which will display all of the Products you have selected to purchase. It is your responsibility to check that the items in your cart are the correct style, colour and size before proceeding. Once you are ready to proceed with your order, click on “Checkout”. The “Checkout Method” page will be shown: you can then finalize the purchase as guest or as registered customer. After choosing your preferred checkout method, follow the instructions and fill the information requested. At the end of the procedure, you will be redirected to he Paypal website to proceed with the payment. If you don’t have a Paypal account you can choose to pay with your credit or debit card. You will then receive an e-mail confirming that the order has been correctly placed (“Order Confirmation E-mail”).2. Once the order has been placed, please note that the shipment address used for the order cannot be changed. If you want to change it, the original order has to be canceled and you need to place a new one. In case of need, please contact info@monokol.it.3. All orders are subject to acceptance and availability. Please be aware that the products in your cart are not reserved and can therefore be purchased by other users until you complete the whole checkout process and receive the Order Confirmation E-mail. In any event, your offer shall be deemed as accepted and the relevant contract of sale is effective only from the moment when you receive a second e-mail expressly informing you about the acceptance by Oculus of your order, the dispatch time, the essential characteristics of the purchased products, and including a detailed breakdown of the price paid for each product, and delivery costs and details (“Shipping Confirmation E-mail”).4. Oculus reserves the right not to accept your order at its own discretion. In such case, Oculus will inform you by email of the cancellation of the order.5. By submitting an order, you unconditionally accept and undertake to comply with these Terms & Conditions as well as with the other policies contained in the Website.6. If you want to cancel an order already placed you must do it before receiving our Shipping Confirmation E-mail: afterwards, you may still obtain a refund or a substitution according to our Withdrawal and Return Policy.7. If some shipping detail is missing in your order (as incorrect address, phone number, or further information needed for the shipment) and you do not provide the missing information within 15 (fifteen) days, we will automatically cancel and refund your order. You will be able to place it again on our Website.8. Orders are processed and shipped from Monday to Friday.

8. PRICES AND PAYMENTS
1. The prices indicated on each product page may not be inclusive of all applicable taxes, depending on the Country of destination. Prices are subject to changes. However, such changes will not impact the price, or the description of the products for which you have already submitted an order accepted by Oculus.2. Although we have taken all reasonable care to make sure that prices contained in the Website are accurate at the time of publication, a small number of products in our Website may be mispriced. Prices are confirmed when you will receive your order receipt email outlining the different charges (including shipment costs and applicable taxes depending on the Country of destination).3. We take reasonable care to make our Website secure. All payments on our Website, including credit/debit card transactions, are processed through Paypal, a secure online payment gateway that encrypts your card details in a secure host environment.

9. DELIVERY
1. We aim to deliver within 4 (four) working days from the date when the order is placed. Any delay in shipment due to either carrier issues and/or exceptional or particular conditions related to the specific Country of destination is not under our responsibility. Some delay may occur during national Holidays. In the event of strikes, difficulties or other events due to general or local extraordinary conditions, which would influence the delivery of the products, we shall be authorised to postpone deliveries or to cancel them.2. We ship worldwide. Shipments inside European Community take about 3/4 working days since the date of the shipment; shipments to the rest of the world take about 6/7 working days since the date of the shipment.3. You may be required to sign for delivery. Before signing you must inspect the package for any obvious tampering. If you receive an empty package but you sign the delivery receipt and do not immediately report the fact to the carrier, we are not responsible for any refunding or substitution. You have to keep the receipt of the delivered product in case of future needs with us about it.

10. WITHDRAWAL AND RETURN POLICY
1.Our return policy includes the possibility of annulment: you may decide to withdraw from the contract and return all or only a portion of what you have purchased and request a refund; you can withdraw from the contract without giving any reason and without any penalty, by an unequivocal statement (by sending an email to Customer Services at: info@monokol.it), no later than 15 (fifteen) working days from the day on which you acquire (or a third party other than the carrier and indicated by you acquires, physical possession of the goods). Once we authorize the return of the products, you will have 14 (fourteen) days to ship the products back at your own expense. Customer Services will inform you where to send the goods in order to reduce the time and cost of shipping.Please note that each product must be returned undamaged, in its original packaging and with all the accessories present at the time of purchase. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. In the event that Oculus discovers the lack of one or more parts of the goods, the company reserves the right not to accept the returned product, or to charge the cost of the missing parts.
HOW TO RETURN GOODS
2. To start the return process, you must ensure that you have the purchase order number to hand before contacting Customer Services at info@monokol.it. 3. Once approval has been given by Oculus to proceed with the return process, you will have to arrange shipment at your own expense; remembering to place the products in their original box, to include all accessories and information material, and to attach a copy of the return acceptance email. To maintain the integrity of the product (and to be able to benefit from the return service), we recommend to pack the original box in a second protective carton suitable for shipping. On receipt of the products, we will examine them carefully to ensure they are undamaged and complete in every part. 4.Once we have ascertained the integrity of the returned products, we will proceed as follows:(a) If you withdraw from the contract and return all the products you have purchased, we shall refound your order using the same means of payment as you used for the initial transaction; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

11. WARRANTY
1. Oculus warrants to the consumer that the products purchased from its online store comply with the specifications and are free of material defects and workmanship errors for a period of twenty-four (24) months from the date of delivery.2. This warranty applies only to products which are(a) manufactured by or for Oculus as identified by the “MONOKOL®” trademarks, trade name, or logo legally affixed to them, and(b) purchased by consumers from this Website. Products purchased from other unauthorized channels and from websites such as eBay, Amazon, etc. are not covered by these Terms & Conditions, and any problems that may arise in those cases need to be discussed and settled directly with the vendors from whom you purchased the product.3. Signs of wear and tear, such as scratches on lenses, will not be considered as product defects, but as events generated by normal use and therefore not covered by warranty.4. This warranty does not apply (i) if the product has been subject to improper use, repair, alteration and/or modification not authorized by the brand;(ii) to damages caused by failure to follow the instructions covered in the documentation for the products or other specific instructions from Oculus;(iii) if the product is damaged by misuse, abuse, negligence, accident, normal wear and tear and deterioration, improper environmental conditions or lack of responsible care,(iv) to damages due to any other cause not related to defective design, workmanship and/or materials.5. This warranty is in addition to your legal rights in relation to products that are faulty or not as described.
HOW TO APPLY
6. In order to benefit from the warranty under these Terms & Conditions you must provide proof of purchase of the item from Oculus’s online store at “www.monokol.it” and send it along with one or more photos of the products showing the alleged defects or lack of conformity to the following email address: info@monokol.it (within a period of 2 (two) months from the date on which you detected such defects or lack of conformity).7. After a preliminary appraisal of the problem, and only where this warranty applies, we will ask you to ship the products back to us, using the delivery service provided by our Customer Services. (To ensure that glasses do not suffer additional damage in transit, you will be asked to pack them in a protective box no larger than 200 x 160 x 100 mm). If these instructions are not followed, we reserve the right to rely solely on the pictures that you sent us before shipping the products back, and we will not be responsible for any further damage caused to the products in transit.
PRODUCTS WITH A VALID WARRANTY
8. If your complaint is communicated by email at info@monokol.it within 24 (twenty-four) months of purchase, and the defect or lack of conformity is recognized by Oculus as a defect in materials and/or production, the product will be replaced free of charge with a new one. If the model in question is no longer available or out of production, you will be offered the opportunity to choose a model of equal value. Your decision in this regard must be notified to us within 10 (ten) working days from our last communication approving your complaint.9. If your complaint is communicated by email at info@monokol.it within 24 (twenty-four) months of purchase, but is not recognized by Oculus as a defect in materials and/or production, you will be contacted directly by our Customer Services.
PRODUCTS WITH AN EXPIRED WARRANTY
10. If your complaint is communicated by email at info@monokol.it after the warranty has expired, i.e. after 24 (twenty-four) months from time of purchase, you will be contacted directly by our Customer Services.

12. SEVERANCE
If any provision of these Terms & Conditions shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these Terms & Conditions, which shall remain in full force and effect.

13. GOVERNING LAW AND JURISDICTION
1. These Terms & Conditions and the other policies of the Website shall be governed by and interpreted in accordance with the laws of Italy. 2. All disputes arising in connection with these Terms & Conditions shall be subject to the non-exclusive jurisdiction of the court of Santa Maria Capu Vetere (CE), without affecting any consumer’s right to start a claim before the courts of the place of residence.

in compliance with the provisions of EU Reg. 2016/679 (European Regulations for the protection of personal data) – GDPR we provide the necessary information regarding the processing of personal data provided. The information must not be considered valid for other websites that may be consulted via links on the internet sites owned by the Data Controller, which is not to be considered in any way responsible for third party websites. This is an information that is provided pursuant to art. 13 of EU Reg. 2016/679 (European Regulation for the protection of personal data) and is also inspired by the provisions of Directive 2002/58 / EC, as updated by Directive 2009/136 / EC, regarding Cookies and envisaged by the Provision of the Authority for the protection of personal data of 08.05.2014 on Cookies. By using our Services you accept that Oculus S.r.L. use your personal information as described in this Privacy Policy.

  1. HOLDER OF THE TREATMENT

N IT03827420617 To exercise their rights, provide comments, submit questions and requests relating to the processing of data the user can contact Oculus S.r.L. at: privacy.oculus@monokol.it

  1. DATA COLLECTION OF USERS

When completing the order form at www.monokol.it or from used by the Web Application to manage the orders by our Agents, to Customer is required to provide data concerning them, such as complete name or Company Name, and contact details to get in touch like (es. e-mail address, VAT number or Vat Code, telephone number and address where to deliver the order). At the time of entering the data by the online Customer or Retailer Customer by web application supplies our Agents, the user is provided via email, or by website link of the Privacy Policy. For the purchase or through the website o by the web application used by our agents, this implies the authorization to the processing of personal data by Oculus Srl. If the user does not consent to the processing of data, the order, therefore the service are not provided.

On the contrary, afterwards the user or the Agent present at the time of the order inserts the personal datails, once the order procedure is completed,the Customer can proceed with the payment of the same.

At the time of payment, the user is redirected to the dedicated web page and designed according to the tools provided by the “Pay pal” or “Dilapay” payment system if it is a final consumer. Within the page, the user must enter the name and surname of the card holder with whom he wishes to make the payment, the card number, the expiry date and the security code. The card data is not stored in the Oculus S.r.L. system, but from third parties who manage online payment. (eg Pay Pal Dilapay etc.)

If the Customer is a Retailer or B2B reseller, the data are entered at the time of order by one of our Agents through the Web App that is connected to the website www.monokol.it the data provided spontaneously by the Customer need to finalize the purchase proposal that is followed by an informational e-mail with the order summary and the Privacy Policy. In the case of errors in sending the order or any communication, the user can communicate it by mail to the address: privacy.oculus@monokol.it with the request for data cancellation. In any case if the order will be not completed by payment or will be not finalized the User details will be canelled by our sistem within three months.

PAYMENT MANAGEMENT

The Data Controller may process some Personal Data of the User, on the occasion of payments made by the latter, through Third Party payment services (such as Pay Pal/Dilapay/Banking System). The Data relating to the payment instrument will be processed only by the Third Party that provides the payment service. The User is invited, upon payment, to carefully read the terms and conditions of the payment service and the information on the Processing of Personal Data available on the website of the Third Party.

  1. PURPOSE AND LICENSE OF TREATMENT

The personal data provided will be processed in compliance with the conditions of lawfulness art. 6 EU Reg. 2016/679 for the following purposes:

the collection of data for the compilation of the order form in the website monokol.it or on the online form for the retailer, or with web application to collect order by our Agents so as to:

  1. to generate your account in order to allow you to place orders;
  2. identify yourself when accessing your account;
  3. notify you of changes or updates to our services by e-mail;

Only subject to your specific and distinct consent for the following marketing purposes:

  1. send you via e-mail, newsletter, commercial communications and / or advertising material on products or services offered by the Owner; in fact, the user is informed that the sending of advertising material is subject to the provision of the relative consent (optional).

4.TREATMENT METHODS

The processing of your personal data is carried out by means of the operations indicated in the GDPR: modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data. Your personal data are subjected to both paper and electronic processing.

  1. ADDRESSEES OR CATEGORIES OF ADDRESSEES OF DATA

The personal data provided may be disclosed to recipients who will process the data as natural persons acting under the authority of the Data Controller, in order to comply with the contracts or related purposes. Precisely, the data may be disclosed to recipients belonging to the following categories:

– Subjects that provide services for the management of the information system and of the communication networks of Oculus S.r.L. (including e-mail);

– Studies or companies in the context of assistance and consultancy relationships;

– Competent authorities for compliance with legal obligations and / or provisions of public bodies, upon request;

The subjects belonging to the aforesaid categories perform the function of Data Processing Manager, or operate in complete autonomy as separate Data Controllers. The list of designated data processors is constantly updated and available at Oculus S.r.L.

  1. DATA SECURITY AND CONSERVATION

Oculus S.r.L. implements appropriate measures to protect user data from unauthorized access, non-compliant processing and accidental loss, destruction and damage. The treatment will be carried out with methods and instruments aimed at guaranteeing maximum security and confidentiality, by subjects specifically appointed to do so. In compliance with the provisions of art. 5 paragraph 1 letter e) of Reg. UE 2016/679 the personal data collected will be stored in a form that allows identification of data subjects for a period of time not exceeding 12 months.

  1. DATA TRANSFER TO A THIRD COUNTRY AND / OR AN INTERNATIONAL ORGANIZATION

The personal data provided will not be transferred abroad within or outside the European Union.

Under Article 7 of the GDPR, each user has the right to obtain confirmation of the existence or otherwise of his personal data, even if not yet registered, and their communication in intelligible form. In particular, you have the right to obtain from Oculus S.r.L. the indication:

1) of the origin of personal data;

2) of the purposes and methods of treatment;

3) of the logic applied in case of treatment carried out with the aid of electronic / IT tools;

4) the identity of the owner;

5) of the subjects and the categories of subjects to whom the data can be communicated or who can learn about them as outsourced and authorized managers (former Agents).

 

Furthermore you have the right to obtain from Oculus S.r.L .:

1) updating, rectification or integration of their data;

2) cancellation, transformation into anonymous form or blocking of data processed in violation of the law;

3) access to your personal data, that is the confirmation that personal data concerning you are being processed;

4) the limitation of treatment;

5) the portability of the data, that is the right to receive in a structured format the personal data concerning you;

6) the right of complaint to the Control Authority.

Finally, you have the right to object, in whole or in part, for legitimate reasons to the processing of personal data concerning you, even if pertinent to the purpose of the collection. The provision of data for the purposes of sending e-mail newsletter for commercial communication purposes is optional and the refusal to give consent to the treatment will result in the impossibility of being updated about commercial and promotional news. In particular, you have the right to object to the processing of personal data concerning you for the purpose of sending advertising material for commercial communication.

  1. REVOCATION OF CONSENT

The interested party can revoke their consent to receive promotional and commercial communications immediately, by sending a request to the above address: privacy.oculus@monokol.it, or by clicking on the unsubscribe link that can be found in the footer of each promotional email and commercial receipt.

Oculus S.r.L. reserves the right to modify, supplement or update this information periodically in accordance with the applicable law or the measures adopted by the Authority for the Protection of Personal Data.

The aforementioned changes or additions will be brought to the attention of all users through the link to the “Privacy Policy” page on the www.monokol.it website and will be communicated directly to the interested parties by e-mail.

Per esercitare i propri diritti, fornire commenti, presentare domande e le richieste relative al trattamento dei dati l’utente può rivolgersi a Oculus S.r.L. privacy.oculus@monokol.it

  1. RACCOLTA DI DATI DEGLI UTENTI

Al momento della compilazione del form di ordine in www.monokol.it o da form utilizzato da Web App per gestire gli ordini dei nostri Agenti presso i retailer è richiesto ai Clienti di fornire dati che lo riguardano, quali nome, cognome o ragione sociale, e i recapiti per mettersi in contatto con il cliente stesso (es. indirizzo email, partita iva o codice fiscale, numero di telefono e indirizzo ove consegnare l’ordine). Al momento dell’inserimento dei dati da parte del Cliente o di un nostro Agente , all’utente viene fornita via mail, tramite pdf, o tramite il link l’informativa sulla Privacy.

L’invio dell’ordine via web tramite il form presente sul sito per l’acquisto, o tramite web app utilizzata dai nostri agenti implica l’autorizzazione al trattamento dei dati personali da parte di Oculus S.r.l.. Qualora l’utente non acconsenta al trattamento dei dati, l’ordine e quindi il servizio non vengono erogati.

Al momento dell’inserimento dei dati personali e, una volta completata la procedura di ordine, quindi l’utente viene reindirizzato alla pagina web dedicata e progettata in base agli strumenti forniti dal sistema di pagamento “Pay pal” o “Dilapay” se si tratta di un consumatore finale. All’interno della pagina, l’utente, dovrà inserire il nome e il cognome dell’intestatario della carta con cui desidera effettuare il pagamento, il numero della carta, la data di scadenza e il codice di sicurezza. I dati della carta non vengono memorizzati all’interno del sistema di Oculus S.r.L. ma dalle parti terze che gestiscono il pagamento on line. (es. Pay Pal Dilapay ecc.)

Nel caso cui il Cliente sia un Retailer o rivenditore B2B i dati vengono inseriti al momento dell’ordine da un nostro Agente tramite Web App la quale è collegata al sito www.monokol.it ., i dati forniti spontaneamente dal Cliene occorrono a finalizzare la proposta di acquisto che viene seguita da una email informativa con il riepilogo ordine e la Privacy Policy. Nel caso di errori di invio cancellazione dell’ordine o qualsiasi comunicazione l’utente potrà comunicarlo a mezzo mail all’indirizzo: privacy.oculus@monokol.it con la richiesta di cancellazione dei dati.

Nel caso in cui non venga finalizzato l’ordine per qualsiasi motivo (es. cancellazione, mancato pagamento, ripensamento ecc.) i dati del Cliente verranno cancellati dai nostri sistemi entro sei mesi.

GESTIONE DEI PAGAMENTI

Il Titolare potrebbe trattare alcuni Dati Personali dell’Utente, in occasione dei pagamenti effettuati da questi ultimi, tramite servizi di pagamento di Terze Parti (come Dilapay/Pay Pal/ Carte di Credito o Circuiti Bancari). I Dati relativi allo strumento di pagamento saranno trattati unicamente dalla Terza Parte che presta il servizio di pagamento. L’Utente è invitato, in occasione del pagamento, a consultare attentamente i termini e condizioni del servizio di pagamento e l’informativa sul Trattamento dei Dati Personali disponibile sul sito della Terza Parte.

  1. FINALITÀ E LICEITA’ DEL TRATTAMENTO

I dati di natura personale forniti, saranno oggetto di trattamento nel rispetto delle condizioni di liceità art. 6 Reg. UE 2016/679 per le seguenti finalità:

la raccolta dei dati per la compilazione del form presente nel sito web www.monoko.it o tramite Web App fornita ai nostri Agenti occorrono a:

  1. generare il Suo account al fine di consentirLe di effettuare ordini;
  2. identificarsi all’accesso al Suo account;
  3. avvisarLa delle modifiche o aggiornamenti dei nostri servizi via e-mail;

Solo previo Suo specifico e distinto consenso per le seguenti finalità di marketing:

  1. inviarLe via e-mail, newsletter, comunicazioni commerciali e/o materiale pubblicitario su prodotti o servizi offerti dal Titolare; si informa, infatti, l’utente che l’invio di materiale pubblicitario è subordinato alla prestazione del relativo consenso. (opzionale)

 

4. MODALITA’ DI TRATTAMENTO

Il trattamento dei Suoi dati personali è realizzato per mezzo delle operazioni indicate nel GDPR: modificazione, selezione, estrazione, raffronto, utilizzo, interconnessione, blocco, comunicazione, cancellazione e distruzione dei dati. I Suoi dati personali sono sottoposti a trattamento sia cartaceo che elettronico.

  1. DESTINATARI O CATEGORIE DI DESTINATARI DEI DATI

I dati di natura personale forniti potranno essere comunicati a destinatari che tratteranno i dati in qualità di persone fisiche che agiscono sotto l’autorità del Titolare del Trattamento, al fine di ottemperare ai contratti o finalità connesse. Precisamente, i dati potranno essere comunicati a destinatari appartenenti alle seguenti categorie:

– Soggetti che forniscono servizi per la gestione del sistema informativo e delle reti di comunicazione di Oculus S.r.L. (ivi compresa la posta elettronica);

– Studi o Società nell’ambito di rapporti di assistenza e consulenza;

– Autorità competenti per adempimenti di obblighi di legge e/o di disposizioni di organi pubblici, su richiesta;

I soggetti appartenenti alle categorie suddette svolgono la funzione di Responsabile del trattamento dei dati, oppure operano in totale autonomia come distinti Titolari del trattamento. L’elenco dei Responsabili del trattamento designati è costantemente aggiornato e disponibile presso la sede di Oculus S.r.L.

  1. SICUREZZA E CONSERVAZIONE DEI DATI

Oculus S.r.L. implementa apposite misure volte alla protezione dei dati degli utenti dall’accesso non autorizzato, dal trattamento non conforme alla legge nonché dalla perdita, dalla distruzione e dal danneggiamento accidentali. Il trattamento sarà svolto con modalità e strumenti volti a garantire la massima sicurezza e riservatezza, ad opera di soggetti di ciò appositamente incaricati. Nel rispetto di quanto previsto dall’art. 5 comma 1 lett. e) del Reg. UE 2016/679 i dati personali raccolti verranno conservati in una forma che consenta l’identificazione degli interessati per un arco di tempo non superiore a 12 mesi.

  1. TRASFERIMENTO DATI VERSO UN PAESE TERZO E/O UN’ORGANIZZAZIONE INTERNAZIONALE

I dati di natura personale forniti, non saranno trasferiti all’estero all’interno o all’esterno dell’Unione Europea.

  1. DIRITTI DEGLI INTERESSATI

Ai sensi dell’art.7 del GDPR, ciascun utente ha il diritto di ottenere la conferma dell’esistenza o meno dei suoi dati personali, anche se non ancora registrati, e la loro comunicazione in forma intellegibile. In particolare, Lei ha diritto di ottenere da Oculus S.r.L. l’indicazione:

1) dell’origine dei dati personali;

2) della finalità e delle modalità di trattamento;

3) della logica applicata in caso di trattamento effettuato con l’ausilio di strumenti elettronici/informatici;

4) gli estremi identificativi del Titolare;

5) dei soggetti e delle categorie di soggetti ai quali i dati possono essere comunicati o che possono venirne a conoscenza in qualità di responsabili in outsourcing e autorizzati (ex incaricati).

Inoltre Lei ha diritto di ottenere da Oculus S.r.L.:

1) l’aggiornamento, la rettificazione ovvero l’integrazione dei propri dati;

2) la cancellazione, la trasformazione in forma anonima o il blocco dei dati trattati in violazione di legge;

3) l’accesso ai propri dati e cioè la conferma che sia o meno in corso un trattamento di dati personali che La riguardano;

4) la limitazione del trattamento;

5) la portabilità del dato, cioè il diritto di ricevere in formato strutturato i dati personali che La riguardano;

6) il diritto di reclamo all’Autorità di controllo.

Infine, Lei ha il diritto di opporsi, in tutto o in parte, per motivi legittimi al trattamento dei dati personali che La riguardano, ancorché pertinenti allo scopo della raccolta. Il conferimento dei dati per le finalità di invio newsletter via mail per scopi di comunicazione commerciale è facoltativo ed il rifiuto a prestare il relativo consenso al trattamento darà luogo all’impossibilità di essere aggiornati circa le notizie commerciali e promozionali. In particolare, Lei ha il diritto di opporsi al trattamento dei dati personali che La riguardano ai fini di invio di materiale pubblicitario di comunicazione commerciale.

  1. REVOCA DEL CONSENSO

L’interessato può revocare il proprio consenso alla ricezione di comunicazioni promozionali e commerciali immediatamente, inviando richiesta all’indirizzo di cui sopra: privacy.oculus@monokol.it, oppure cliccando sull’apposito link di disiscrizione che potrà trovare nel footer di ogni mail promozionale e commerciale ricevuta.

Oculus S.r.L. si riserva il diritto di modificare, integrare o aggiornare periodicamente la presente informativa in ossequio alla normativa applicabile o ai provvedimenti adottati dal Garante per la Protezione dei dati personali.

Le suddette modifiche o integrazioni saranno portate a conoscenza di tutti gli utenti mediante il link alla pagina “Privacy Policy” presente nel sito web www.monokol.it e saranno comunicate direttamente agli interessati a mezzo e-mail.

Invitiamo gli utenti a prendere visione della Privacy Policy con regolarità, per verificare eventuali modifiche all’informativa e decidere se continuare o meno ad usufruire dei servizi offerti.
